Employer fined over $300,000 after worker’s hand caught in machinery…
The Court has ordered an employer to pay over $300,000 in fines and reparations after one of its employee’s hands was caught in machinery.
The machine had several moving parts that could be a risk. The employer failed to install any protective guards around these parts.
The employee’s hand was caught in the machinery, causing serious injuries and permanent damage.
Worksafe described the requirement to install guards on hazardous machinery not only as a legal requirement, but as the basics of health and safety.
The Court held that the employer’s failure to protect its employee was significant, and ordered the employer to pay a fine of $260,000 in addition to reparation of $40,568 to the employee for emotional harm and lost income.
It is important that employers take all steps reasonably practicable to eliminate or minimize any risks to their employees.
